REPRESENTATIVE CASES

Neurology Malpractice: A man who went blind due to alleged failure to control intracranial pressure during a neurological infection, sued the Chicago-area hospital and its physicians, and settled the case for over $1 million.
Fiduciary Breach: A group of siblings who were beneficiaries to a trust sued a corporate bank as trustee over losses to real property value. After 2+ years of litigating, CorePoint Law settled for multiple 6-figures.
Noncompete Agreement: two employees left their company to start a competitor and were aggressively pursued for noncompete/nonsolicit violations. CorePoint refuted the accusations, releasing them from their noncompete.
Ophthalmology Malpractice: A patient (himself a family medicine physician), sustained a displaced lens due to an ophthalmologist in downstate Illinois, leading to losses in his income. The case is pending in Jefferson County.
Medical Cosmetics: an MD/NP couple attempted to partner with a cosmetologist to offer "medspa" treatments. She kept $30,000 advanced by the MD/NP after the deal fell through, but continued to offer medical treatments. The lawsuit against the cosmetologist is pending.
Dispensary Law: A cannabis licensee was building a new dispensary in Niles, Illinois, when his conditional permit was pulled by the municipality, leaving an unpaid bill of $50k to the architecture/design firm on the project, who sued him for their balance. The client settled against the value of the sale of the dispensary license itself.
Foreclosure Lien: A family whose elderly father held a $60,000 promissory note against a residential property, was able to join a foreclosure of the mortgage company by joining as a junior lienholder to collect against the sale.
Startup Equity: an Atlanta woman joined a Chicago tech startup and worked fulltime for two years with no salary on expectation of equity, then was summarily terminated to free up shares in the company for other investors.
Landlord Law: the client, who purchased a two-flat in Chicago, was sued under the tenant's lease with the prior landlord for security deposit issues. CorePoint won that the client's "owner-occupant" status applied as of the time of the lawsuit, not as of the original lease (where the prior landlord was not an owner-occupant), saving the client from special damages under the Landlord-Tenant Ordinance, which are excluded to owner-occupant landlords.
Property Disputes: in two cases, a house was purchased in sole title, but a family member claimed to own half or all of it based on equitable claims. CorePoint Law gained both defendants' retaining ownership to the properties.
Bank Garnishment: an out-of-state judgment was successfully collected against an Illinois lab testing company for $67,000 plus an additional $3,000 for interest and costs, via garnishment of the Defendant's bank accounts.
Contract Drafting: CorePoint reviews and/or drafts contractual terms for investment, employment, leasehold, acquisition, partnership, operating agreement, business venture, and more.
FAQ

LLC v. LLP v. Corp.: An individual, group, or pair may "incorporate" as any number of available legal structures. Major examples include PC (Professional Corporation), LLC (Limited Liability Company), S-Corp (S-Chapter Corporation), as well as LLP (Limited Liability Partnership). The difference in what kind of structure you are - or intend to be - has different implications, the usual important ones being: taxation, liability, and organization. CorePoint does not handle tax, nor bankruptcy, issues of law. But the processes for incorporation, operating and shareholder agreements, and personal liability to individual members or partners are some of the most frequent issues that arise in business litigation. Whether you are starting a new company or already have an existing one, CorePoint can help you understand the legal implications of your entity type.
Tort v. Contract: A "tort," historically, is a civil violation between one party and another of general rights and duties. For example, people may not knowingly interfere with each other's business or economic relations, may not defame each other's reputation, and must fulfill the heightened standards that apply as professionals. Contracts are not general/public duties, but a local set of obligations between parties which may be enforced if breached. Torts are negligent (or intentional) violations of general duties. Both tort and contract lawsuits involve a breach of rights causing damages, the difference being what kind of rights have been violated, and what kind of damages may be available (restitutive, emotional, punitive, statutory, compensatory, etc.).
Appeal & Precedent: Trial courts are bound to hold by precedents set in previous cases ruled upon in an Appellate or Supreme Court. Judicial decisions made in the trial court are not globally precedential. If an appeal is taken from a trial court decision, it means the application of law to the trial proceedings is being challenged. The appellate court may: a) overrule or affirm the lower court decision, which then reverses or affirms the decision made in your case, and in so doing b) creates a decision which becomes precedent to cases in the future. The decision to take an appeal is relevant when a client feels that a different result should have been reached, and the challenged application of law has potential to become the basis of new trial court decisions in the future.
PROCESS

Situation - you have been injured (physically, emotionally, financially) due to someone's legal failure, be it your employer, landlord, or business partner. You make a claim to recoup the loss.
Negotiation - legal action is needed where parties cannot resolve disputes. You first attempt a direct resolution before going to court, engaging counsel only for advisory and strategic purposes.
Litigation - you file a complaint in State or Federal Court, Arbitration, Administrative Tribunal, or other forum, conduct motion practice and discovery until the case has been "worked up," and prepare for trial.
Settlement - following 1-2+ years of discovery and pretrial litigation, the parties may be able to determine their own likelihood of success, and reach a settlement, saving the expense and risk of trial, which is all-or-nothing.
Trial - the evidence collected in discovery is presented to a jury or judge to decide.
Collection - judgments awarded must be actually realized using tools at the court's disposal (e.g. property liens, wage garnishments, freezing accounts), typically unless a defendant is a large company or has insurance.
Resolution - lawsuits are neither a casino nor a TV show; all the law accomplishes is bringing parties to "zero," that is, replacing a loss rather than creating a gain. The monetary judgment is its own vindication.
